dc.description.abstractÇocuk ceza yargılanması sistemi, suç işleyen çocukların adaletle ve aynı zamanda onların yaş, gelişim düzeyi ve özel ihtiyaçlarını dikkate alarak ele alınmasını sağlayan bir yaklaşımı benimsemektedir. Bu sistem, sadece suçun cezasını belirlemekle kalmaz, aynı zamanda çocuğun yeniden topluma entegrasyonunu ve gelecekte suç işlememesini sağlamak için rehabilitasyon ve destek sağlar. Bu bağlamda onarıcı adaletin alternatif bir yöntemi olarak geliştirilen, çocuk ceza yargılanması sisteminin önemli bir unsuru olan uzlaştırma, suç işleyen çocuklarla toplum arasında yeniden bağlar kurmayı, çocuğun üstün yararını gözeterek sorunları çözmeyi hedefler. Uzlaştırma süreci, çocuğun suçunu kabul etmesini, zarar görenle veya toplumla uzlaşmasını ve suçun nedenlerini anlamasını sağlar. Bu süreç, sadece ceza vermekten ziyade çocuğun sorumluluğunu kabul etmesini teşvik eder ve gelecekte suç işlemesini önlemek için yapıcı bir rol oynar. Bu çalışmada, çocuk ceza yargılanması sisteminde uzlaştırmanın önemi ve etkisi üzerinde durulacaktır. Uzlaştırma sürecinde çocukların yargılanma sürecine ihtiyaçları doğrultusunda neler yapılabileceği, gelişim süreçlerinin sağlıklı ve verimli ilerleyebilmesi için nelere dikkat edilmesi gerekir gibi konular üzerinde durulacaktır.
dc.description.abstractThe juvenile criminal justice system adopts an approach that ensures that children who commit crimes are handled with justice, taking into account their age, developmental level and special needs. This system not only determines the punishment for the crime, but also provides rehabilitation and support to ensure the child's reintegration into society and the avoidance of future crimes. In this context, mediation, which was developed as an alternative method of restorative justice and is an important element of the juvenile criminal justice system, aims to establish new ties between children who commit crimes and the society, and to solve problems by considering the best interests of the child. The mediation process enables the child to admit his/her guilt, reconcile with the victim or society, and understand the reasons for the crime. Rather than simply giving punishment, this process encourages the child to accept responsibility and plays a constructive role in preventing future offending. This study will focus on the importance and impact of mediation in the juvenile criminal justice system. During the mediation process, issues such as what can be done in line with the needs of children during the trial process and what needs to be taken into consideration so that their development processes can proceed in a healthy and efficient manner will be discussed.
