Özet
Günümüzde özel hayatın gizliliği, başka bir tabirle özel yaşamın korunması, teknolojinin gelişmesi ve kişilerin hem gerçek hem de dijital mecralarda sosyalleşmesi ile temel hak ve özgürlüklerin önemli bir parçası haline gelmiştir. Tezimin birinci bölümünde; özel hayatın gizliliği kavramını daha detaylı şekilde anlatabilmek için kişi ve kişilik hakları kavramlarını, doktrin ve yargı kararları ile anlatmaya başladım. Daha sonra özel hayatın gizliliğinin kapsam ve içeriği Yargıtay kararları ışığında olmak üzere Türk Hukukunda ne gibi sınırlamalarının olduğunu değerlendirdim. İkinci bölümde ise Uluslararası Hukuk açısından özel hayatın gizliliğinin bugüne kadar nasıl geldiği ve Türk Hukukundaki yeri ve diğer hukuk dallarını nasıl etkilediğini inceledim. Üçüncü bölüm olan son bölümde ise Türk Ceza Kanununda özel hayatın gizliliğini ihlal eden suçların tanımlarını ve özelliklerini farklı Yargıtay kararları ışığında inceledim.
Today, the private life, in other words, the protection of privacy life has become the essential part of the basic rights and freedoms, because of the development of technology and the socialization of persons in real and digital media. In the first part of my study, I have started to explain personal and personal rights according to the decisions by doctrine and judicial decisions in order to explain in more detail of the concept of private life. Then, I wanted to explain the scope and content of the private life and the limits of Turkish law especially pursuant to the decisions of Supreme Courts. At the second part of my study, I've studied how the private life has been evolved according to the international law and the aspect of Turkish Law to the private law and how it affected other branches of law. At the third part, in other words, at the last section: I've researched the crimes of the private life stated at the Turkish Penal Code according to the decisisions of the Court of Cassation.
