| dc.description.abstract | Hakaretin kelime anlamı ve hakaret suçunun Türk Ceza Kanun' daki yeri, toplum içerisinde yer alması, kullanımı, nelerin hakaret kapsamında olacağı ve hakaretin sınırlarının nasıl çizileceği, ayrıcakanun koyucunun hakaret eden kişiye uygulayacağı yaptırımlar hakaret suçunun tarihsel gelişimi ve 765 sayılı Ceza Kanunu ile 5237 sayılı TCK' nın kanun sistematiği içerisinde hakaret suçunu incelemeye gayret göstereceğiz. Bu çalışmanın amacı ve önemi günümüzde yoğun olarak kullanılan ve insanların vazgeçilmez bir kullanım aracı olan internet iletişim aracı ve buna bağlı olarak kullanılan sosyal medya ağlarının doğru olarak kullanılmaması halinde karşılaşılacak sorunlar ve bu sorunlara Türk Ceza Yasasının bağladığı cezai yaptırımların anlatılması ve bu sayede bu alanda kişinin onur, şeref, haysiyet gibi değerlerinin toplum nazarında korunması ve bu değerlere yapılacak olağan saldırıların ortadan kaldırılmasına olanak sağlayan ceza sisteminin işlerliğini hep birlikte inceleyeceğiz. | |
| dc.description.abstract | The study will examine the meaning of insult word and insult crime in Turkish Criminal Law, what will be covered in the scope of insult and how to draw the limits of the insult. In addition, the study will investigate the legislative imposed on the insulting person by the legislator, the historical development of the defamation offence and the Criminal Code no. 765 and the crime of defamation within the legal systems of the Turkish Criminal Law No. 5237. The purpose and importance of this study are widely used today the Internet communication tool and correspondingly problems which could be faced because of the using social media incorrectly. For these problems, the penal sanctions imposed by the Turkish Penal Code the protection for the values such as honour and dignity in the face of the society and the effectiveness of the punishment system will be examined. | |
