Özet
Çalışma konumuz kuruluşundan bugüne Türkiye'de resmi olarak bulunmasına izin verilen yabancı devletlerin askeri güçlerini, buna dair sahip oldukları askeri üsleri ve tesislerin hukuki statüsünü, bu askeri güçlerin ve üslerin sahip oldukları hak ve yetkiler ile yerine getirmekle mükellef oldukları yükümlülükleri uluslararası hukuk kuralları ve ev sahibi devlet olarak Türk Hukuku açısından değerlendirmektir. Bununla beraber çalışmada benimsenen amaç Türkiye'de bulunan yabancı askeri üslerdeki görevli personelin işlemiş oldukları suçlar karşısında gerek uluslararası hukuk gerekse ev sahibi devlet olarak Türk Hukuku açısından imtiyazlı bir statüde olduklarını eleştirel bir bakış açısıyla incelemektir. Buna bağlı olarak ayrıcalıklar ve bağışıklıklarda değerlendirme kapsamında tutulmaya çalışılmıştır.
Our focus in the study is to evaluate military forces of foreign countries, their legal status of military bases and istallations, the rights and powers owned by these military forces and bases as well as their obligations in terms of Turkish law system as the host country and international rules of law. The aim of this study is to analyze the privileged status of the staff who works in foreign military bases in Turkey against their committed crimes in terms of Turkish law system as the host country and in terms of international rules of law in a critical way. In addition, related privileges and immunities have been tried to discuss in the framework of the evaluation.
