Özet

Ombudsman Institution –even though founded in various types and fieldsgenerally serves to protect the rights and interests of people, in case any conflict arose between them and administration, resolves the conflict at the swiftest way possible, thus lessens the burden of administrative jurisdiction. The institution is established in the early 18th century in Sweden for the first time. In Turkey the institution founded in 2010 in the 74th article of constitutional law under Public Audition Ombudsman name in pursuant of the amendments made in 1982 constitutional law. In following years this institution is regulated by 14.06.2012 dated 6328 numbered Public Audition İnstitution Law. The law in question offers accurate provisions but also provides insufficient and deficient parts. If insufficient and deficient parts are amended the institution shall function better and in line with its goal
Ombudsmanlık kurumu, halkın idarenin eylem ve işlemleri karşısındaki şikâyetlerini dinleyen, idarenin söz konusu eylem ve işlemlerini hukukilik ve yerindelik açısından değerlendirerek kişilerin hak ve menfaatlerini koruyan, tavsiye mahiyetinde kararlar alan, idare ile vatandaş arasındaki uyuşmazlıkları süratli ve etkin bir şekilde çözümleyen ve yasama ile yürütme organlarından bağımsız olarak hareket eden bir kurumdur.
