| dc.description.abstract | Çalışmanın temel amacı eser niteliğinde olmayan işaret, resim, ses ve bunların hangi hükümlerle korunacağıdır. Ana konunun incelenmesine geçilmeden önce, eserin ne olduğu, bir fikri ürünün eser sayılması için sahip olması gereken özellikler ve Fikir ve Sanat Eserleri Kanunu'nda yer alan eser türleri maddeler halinde açıklanmış ve incelenmiştir. Eser vasfına sahip olmanın ve olmamanın kişiye sağladığı haklar açısından karşılaştırmasının yapılabilmesi için eserin sahibine sağladığı manevi ve mali haklardan bahsedilmiştir. Daha sonrasında eser olma vasıflarını taşımayan işaret, resim ve sesler açıklanmış, en son olarak da bunların korunmasına ilişkin hükümler, eserlere ilişkin korumalarla karşılaştırmalı olarak verilmiştir. | |
| dc.description.abstract | The main purpose of the study is to examine signs, pictures and sounds that are not works and the provisions that protect them. Before proceeding to the examination of the main subject, what a work is, the characteristics that an intellectual product must have in order to be considered a work, and the types of works included in the Law on Intellectual and Artistic Works are explained and analyzed in articles. The moral and financial rights provided to the owner of the work are mentioned in order to make a comparison in terms of the rights provided to the person by having and not having the qualifications of being a work. Afterwards, signs, pictures and sounds that do not qualify as works are explained, and finally, the provisions regarding their protection are given in comparison with the protection of works. | |
