Aracın kaza öncesindeki piyasa değerinin kaza sonrasında meydana gelen hasarın onarılması nedeniyle azalması, araçtaki değer kaybını ifade etmektedir. Değer kaybının belirlenmesinde kaza tutanakları, aracın hasara ilişkin resimleri, hasarın onarımı sonrasındaki resimleri, onarımın yapıldığı yer, kullanılan parçalar gibi hususlar önem taşımaktadır. Uygulamada değer kaybı hesaplamaları, teknik bilgi gerektirmesi nedeniyle eksperler ve bilirkişiler tarafından yapılmaktadır. Bu çalışmanın amacı, değer kaybının tüm boyutlarıyla incelenmesi ve değer kaybına ilişkin Türkiye'de gerçekleşen hukuki değişiklikler ile uygulamada görülen sorunların değerlendirilmesidir. Literatür taraması şeklinde hazırlanan çalışmada güncel Yargıtay kararlarına ve uygulamalara yer verilerek literatüre katkı sağlamak hedeflenmiştir. Çalışmada değer kaybının hesaplanması konusunda 2020/40 sayılı Anayasa Mahkemesi kararıyla ortaya çıkan değişim detaylı şekilde ele alınarak incelenmiş ve sonuç olarak uygulamadaki sorunların çözülmesi için önerilerde bulunulmuştur.The probability of damage to vehicles after a traffic accident is quite high due to the normal flow of life. The aim of this study is to examine the depreciation in all its dimensions and to evaluate the legal changes in Turkey regarding Depreciation and the problems seen in practice. In the study, which was prepared as a literature review, it was aimed to contribute to the literature by including the current Supreme Court decisions and practices.
