Özet
İşbu tezin ana konuları 4721 sayılı Türk Medeni Kanunu kapsamında evlenme, evliliğin genel hükümleri, evliliğin genel hükümlerinden özel olarak sadakat yükümlülüğü sadakat yükümlülüğünün sona ermesi ile bağlantılı olarak evliliğin sona ermesidir. Toplumun temelini oluşturan aile ve varlığını meydana getiren evlenme ve süreç devam ederken oluşturduğu evlilik birliği toplumsal süreklilik açısından çok büyük önem teşkil etmektedir. Bu kapsamda çalışmamızın ilk bölümünde, evlenme niteliği ve şartlarına değinilerek pozitif hukuk ve doktrin kapsamında değerlendirilmiştir. İkinci bölümde evliliğin genel hükümleri sadakat yükümlülüğü ön planda tutularak incelenmiştir. Üçüncü bölümde evliliğin sona ermesi ile sadakat yükümlülüğünün sona ermesi arasındaki bağlantı incelendikten sonra evliliğin sona ermesi yolları incelenmiştir. Çalışmanın sonucunda, evlenmenin bir sözleşme, sadakat yükümlüğünün dürüstlük kuralının evlenme hukukuna bir yansıma olduğu bulunmuştur. Bunun yanında özellikle son bölüm kapsamında sadakat yükümlülüğünün varlığının her daim sadece evlilik varlığı ile bağlantılı olmadığı ortaya konulmuştur. Tartışmalı olan konular teker teker incelenmiş ve bu konular hakkında görüş ve çözüm önerilerimiz vurgulanmıştır.
Main subjects of this thesis are marriage, the general effects of marriage, especially duty of loyalty in regards to general effects of marriage, the termination of the marriage in connection with the ending of the duty of loyalty within the scope of Law no. 4721 Turkic Civil Law. The family that forms the basis of the society and the marriage that constitutes its existence and the marriage unity formed during the process are very important in terms of social continuity. In this context, in the first part of our study, marriage is evaluated within the scope of positive law and doctrine by mentioning the nature and conditions of marriage. In the second chapter, the general provisions of the marriage were examined by specifically taking into consideration the loyalty obligation. In the third chapter, after discussing the connection between termination of marriage and ending of loyalty obligation, the ways to end the marriage are evaluated. As a result of the study, it was found that marriage was a reflection of the good faith to the law of marriage. In addition to this, it was evaluated that the existance of duty of loyalty is not always dependent of the existance or contuniation of the marriage especially within the last chapter. The topics which are controversial were examined one by one and our opinions and solutions about these issues were emphasized.
