Özet
İnsanlar arasındaki savaş, tarihin başlangıç döneminden itibaren dünyadaki en büyük sorunlardan biri olmuştur. Tarihin en büyük iki savaşı olarak bilinen; I. Dünya Savaşı ve II. Dünya Savaşı yaşandıktan sonra devletler uluslararası arenada bir araya gelerek sırasıyla Milletler Cemiyeti'ni ve Birleşmiş Milletler'i kurmuşlardır. Bu kurumlar, dünyada meydana gelebilecek yeni savaşları engellemeyi amaçlamıştır. Bilimsel ilerlemenin savaş teknolojilerine yansımaları sonrasında savaş; Nagazaki ve Hiroşima örneklerinde olduğu gibi artık geniş çaplı, yıkıcı ve her anlamda yaşamı tehdit eden bir hal almıştır. Bilişim, iletişim ve ulaşımın sağladığı kolaylıklara dayalı olarak savaşlar, çok hızlı şekilde ilerleyebilecek ve tüm dünyaya daha kolay yayılabilecek seviyeye gelmiştir. Birleşmiş Milletler, insani müdahale ile; bu savaşları, bu savaşların ilerlemesini ve yayılmasını, savaşlardan insanların etkilenmesini engellemeyi, insan hakları ihlalleri ve insani krizlerin önüne geçmeyi, dünya barışını ve güvenliğini korumayı amaçlamaktadır. Bu tez çalışmasında, 'insani müdahale' kavramı, bu kavramın uluslararası hukuktaki yeri ve Uluslararası İnsani Müdahale'de Birleşmiş Milletler'in Rolü geçmişten günümüze örnekleriyle açıklanmaya çalışılmış, Kuvvet Kullanma Yasağı, bu yasağın istisnaları, Devletlerin Egemenlik Hakkı"nın İhlali Yasağı ve Koruma Sorumluluğu kavramları uluslararası hukuktaki dayanakları ile birlikte incelenmiştir.
War between people has been the biggest problem in the world since the beginning of history. After the First World War and the Second World War which are known as the two greatest wars in history, states came together in the international arena and formed the League of Nations and the United Nations respectively. These institutions was established with the main mission of preventing new wars that might occur in the world. As a result of the reflections of scientific progress on the war technologies; as in the case of Nagasaki and Hiroshima, war has became widespread, destructive and had life-threatening effects. Moreover, it has reached the point where it could spread very rapidly to the whole world as a result of the devolopments achieved in information, communication and transportation, technologies. The United Nations aims to prevent these wars, the advancement and spread of these wars, also to prevent people from being affected by wars and to prevent human rights violations and humanitarian crises, to protect of world peace and security, through humanitarian intervention. In this thesis, the concept of Humanitarian Intervention, the international dimension of this concept and the role of the United Nations in International Humanitarian Intervention have been tried to be explained with examples from past to present, "The prohibition of using force, exceptions of this prohibition, the prohibition of Violation of States' Right to Sovereignty and Responsibility for Protection" concepts have been examined together with their basis in international law.
